There is no such blanket law saying all babies born in the U.S. to foreign parents are automatically citizens.<\/strong><\/span><\/h2>\n

The test of such citizenship is fact specific and the U.S. Supreme Court established a test in Wong<\/em> to determine the critical issues of jurisdiction, residence and domicile, along with several other prohibitions, one being a parent being subject to a foreign power, which hindsight shows that Kamala\u2019s U.N. One-World Order father Donald was and still is.<\/p>\n

The primary questions in Kamala Harris\u2019 citizenship as having been born of non-US-citizen parents (absent later evidence of naturalization, which she has not provided).<\/p>\n

Since her father\u2019s citizenship governs such matters in U.S. law, for certain, the Jamaican Constitution defines her as Jamaican.<\/strong><\/span><\/p>\n

Now, the question is whether she also qualifies as a citizen under U.S. law at the time of birth.<\/p>\n

To answer this we must turn to the 14th<\/sup> Amendment and the Supreme Court\u2019s clarification of \u201cjurisdiction\u201d in United States v. Wong Kim Ark, 169 U.S. 649 (1898)<\/a><\/em>.<\/p>\n

The Wong Kim Ark<\/em> decision created a simple test for jurisdiction for which all the elements must be true<\/em> before it applies:<\/p>\n

  3. Birth parents have \u201ca permanent domicile and residence in the United States;\u201d<\/li>\n
  4. Birth parents \u201care carrying on business;\u201d and<\/li>\n
  5. Birth parents \u201c are not employed in any diplomatic or official capacity\u201d by the country of their citizenship\u201d<\/li>\n<\/ol>\n

    \u201cDomicile and residence\u201d are questions of law important in many subject areas including taxes, custody, citizenship, student scholarships (in-state vs. out-of-state), etc.<\/p>\n
